We know that doctors believe in CBD and marijuana to have healing properties. And there is always a debate between the way people think and what federation and states’ legislation do. But, we know what sort of questions everyone has in mind, especially after Farm Bill 2018 is signed by President Trump that has legalized hemp, but at the same time, created confusion among the states. So, we will try to answer every question you may have in mind.
CBD oil, which is an oil made from the cannabis plant containing the cannabinoid cannabidiol, is legal in Maine. Both the forms are legitimate, those derived from hemp, as well as those derived from marijuana.

There is a compound named THC, as we discussed above. It is a psychoactive compound. Through research, scientists have concluded that THC levels below 0.3% are safe and can be consumed. But greater levels can cause problems. Now let’s come back to hemp and marijuana. Hemp meets the safety levels, as suggested by research, while marijuana does not. Even though Farm Bill 2018 now allows hemp cultivation, it remains a point of concern for many states.
There are physical differences between hemp and marijuana, as well. Hemp plants lack green stuff and are like bamboo. They have lean stalks. In contrast, marijuana is green, full of flowers, and spread wide.
Does Hemp or Marijuana Have More CBD Oil?
Another point of difference between hemp and marijuana is the amount of resin. Hemp has less, but marijuana has more of it. That’s why a lesser quantity of marijuana leaves can yield a greater amount of CBD Oil than hemp leaves.
Why is CBD Sometimes Illegal In Different States?
It is unfortunate to say that despite the Farm Bill 2018, CBD remains illegal in many states. Some reasons are:
1) The first reason is that people have mixed opinions about legalizing CBD. Some consider it useful and some not. Those who don’t are in the state departments holding high posts are the reason for the hindrance of Federal Law to become fully operational.
2) The second reason is the chemical structure of the CBD. No matter you extract it from hemp or marijuana, it has a similar structure. And that’s why law-making bodies remain confused about fully implementing Farm Bill 2018.
3) The third reason is that a couple of states have left even the farm Bill behind and legalized hemp and marijuana even in consumable items. This does not allow harmony to establish between the states.
Is CBD Oil Legal In Maine?
CBD oil is legal in the state of Maine. However, it comes with a few stipulations. First, CBD, or cannabidiol, a cannabinoid derived from the cannabis plant, is legal for those over the age of 21 in Maine.
Maine has a long history of CBD and cannabis. In 1976 with the decriminalization of small amounts of cannabis, Maine was one of the first few states to start towards legalization.
In 1999 Maine moved forward with the legalization of medical marijuana for qualifying patients.
Further action taken in May of 2009 with the decriminalization of more significant cannabis quantities helped move cannabis even closer to recreational status. Now 2.5 ounces or less would be a civil infraction instead of a criminal act.
In Portland in 2013, the city decided to fully legalize possession of 2.5 ounces or less within the city limits. This move led the way for the separate municipality of South Portland to do the same in 2014.
Finally, in November of 2016, the state voted to pass the full legalization of recreational cannabis for Maine adults.
Red tape, as many often joke about, can hold things back for extended lengths of time. Although the legalization of marijuana passed back in 2016, the full setup of stores and marijuana sales within the state has taken a very long time to get started. It was not until April of 2018 that LD 1719 passed to establish a regulatory framework to oversee the new adult marijuana industry.
Also, in 2019 came the federal Farm Bill. This bill defined hemp and marijuana as differing by primarily CBD, or cannabidiol, in the plant. The plant must contain no more than 0.3% THC volume by dry weight to qualify as hemp.
The final rules for marijuana businesses outlined in June of 2019 in Maine finally brought about legalization. However, despite a target of summer 2020 for the first marijuana stores to open, the pandemic has slowed the process, and it remains underway.
